New Wall

What you need to consider if intending to build a new wall at a boundary

  • which is not built on, or

  • where there is an Adjoining Owners' boundary wall immediately on

    their side of the boundary.


Your rights

Typical works which materially affect the existing wall and require Notice:-
  • To build within 12 months of notice being served, a wall sitting on your property only, except for:-
    • foundations which may be placed below ground level on the adjoining land;
  • Work involving removal or addition of material hanging over your property eg. footing or projecting flue, or other projection such as copings etc., and possibly guttering or roofing.

Your obligations

If the boundary is not evident, to agree its position with the Adjoining Owner(s).

 

Notices
  • A Line of Junction Notice must be served on all the Adjoining Owners
    • one month before the work is intended to start.

Existing Wall

What you need to consider if intending to do work to your own existing external wall built against a Party Wall, or Party Fence Wall.


Your rights

 

Typical works which materially affect the Party Wall and require Notice
  • Work involving removal or addition of structural material to your own wall, including underpinning.

Your obligations

 

Notices
  • A Notice of intention to do the work must be served on all the Adjoining Owners
    • two months before the work is intended to start.
