Rights
To require, by Counter Notice, additional work to be undertaken to a party wall, party fence wall or party structure, to enable use of the wall or structure for their own purposes.
To require, by Counter Notice, that special foundations, if proposed:-
- are to be placed deeper than the Building Owner initially intended, and/or
-
are to be constructed to take any future loads from columns for any building
to be built by the Adjoining Owner.
To request security from the Building Owner for the expenses that would be incurred in order:-
- to make good any damage to their property arising from the work, and/or
- to complete the relevant work should the Building Owner fail to do so.
To require that monetary compensation be paid by the Building Owner instead of making good damage.
To object, by Counter Notice, to the sum stated in the Works Account, within one month of the date of service of the Account.
Obligations
To contribute to the cost of the relevant work in proportion to their use of it;
To pay the cost of requested changes to the design of special foundations;
To pay the Works Account sum to the Building Owner, when due.
- Until the account is settled the ownership of the works remains with the Building Owner.
To pay to the Building Owner reasonable costs that may be determined by the Surveyor(s).
