What you need to consider if intending to build a new Party Wall, on a boundary
which is not built on, or
where there is an Adjoining Owners' freestanding garden wall, immediately on their side of the boundary.
Your rights
If the Adjoining Owners agree-- To build a wall sitting on the boundary, so that each property has half of the wall, or other proportion as agreed between the owners.
- To require a contribution to the construction costs amounting to the proportion of use that the Adjoining Owners make of the wall, as they use it.
- To build a wall sitting on your property only, except for foundations which may be placed below ground level on the adjoining land.
Work which requires Notice and written consent
- The use of reinforced concrete foundations which are also placed on the adjoining land.
Your obligations
Notices-
A Line of Junction Notice must be served on all the Adjoining Owners
- one month before the work is intended to start.
Your neighbour's rights
- To not agree to the work.
Your neighbours' obligations
