Within 14 days of the date of the service of the Party Structure Notice, the Adjoining Owner must respond with a Consent Notice, otherwise a dispute will be deemed to have arisen.
Within 28 days of the date of the service of the Party Structure Notice, the Adjoining Owner may serve a Counter Notice requiring modifications to the proposed work.
A Party Structure Notice must include
- (a) the name and address of the Building Owner;
- (b) the nature and particulars of the proposed work;
- drawings may be used if describing text is not clear enough;
- (c) the intended date on which the proposed work will begin.
If the work includes the construction of special foundations,
- (d) plans, sections and details of construction of the special foundations,
- together with reasonable particulars of the loads to be carried.
The Notice should include
- (i) the name and address of the Adjoining Owner;
- (ii) the date of the Notice;
- (iii) the Building Owner's signature.
Conventionally, the Notice can include
- (iv) the name of the Building Owner's proposed Surveyor, or the name of a Surveyor proposed as an Agreed Surveyor, should the Adjoining Owner disagree;
- (v) an 'Acknowledgement' form where the Adjoining Owner can consent to the works, or object. It should include the key elements of a Consent and Counter Notice, but with the option for the Adjoining Owner to accept the proposed Agreed Surveyor, or nominate their own.
